Terms of Service

01 Acceptance of Terms

By downloading, installing, or using the GAINUP application ("App") or visiting gainup.info, you agree to be bound by these Terms of Service. If you do not agree, do not use the App or Website.

These Terms constitute a legally binding agreement between you ("User") and GAINUP. You must be at least 16 years old to use GAINUP.

02 Description of Service

GAINUP is an AI-powered fitness companion app that provides:

Personalized workout plans tailored to your goals and experience
AI-based meal scanning and nutrition tracking via camera
Progress tracking including body metrics and optional progress photos
AI coaching, daily targets, and fitness recommendations
XP-based progression system and achievement tracking

We reserve the right to modify, suspend, or discontinue any part of the Service at any time without liability.

03 User Accounts

To use GAINUP, you must create an account. You agree to:

Provide accurate, current, and complete information during registration
Keep your credentials secure and not share them with others
Notify us at support@gainup.info immediately if you suspect unauthorized access
Be responsible for all activity that occurs under your account

We may suspend or terminate accounts that violate these Terms or that have been inactive for more than 24 months.

04 Subscriptions & Payments

GAINUP offers both a free tier and a Pro subscription.

Free

Core workout tracking, basic nutrition logging, and limited AI features. No payment required.

Pro

Full AI coaching, unlimited meal scans, advanced analytics, and priority support.

All payments are processed securely through Apple's App Store
Subscriptions auto-renew unless cancelled at least 24 hours before renewal
You can manage or cancel your subscription in your Apple ID settings
Refunds are handled according to Apple's refund policy
We reserve the right to change pricing with 30 days' notice

To cancel: Settings → Apple ID → Subscriptions → GAINUP → Cancel

05 Acceptable Use

You agree not to use GAINUP to:

Violate any applicable law or regulation
Upload content that is harmful, offensive, or infringes on others' rights
Attempt to reverse engineer, decompile, or hack any part of the App
Use automated bots or scripts to access the Service
Impersonate another person or entity
Interfere with the security or integrity of the Service
Use the Service for any commercial purpose without our written consent

Violations may result in immediate account termination without refund.

06 Intellectual Property

All content, features, and functionality of GAINUP — including app design, AI models, workout content, branding, and source code — are the exclusive property of GAINUP and protected by intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license for personal, non-commercial use. This does not include the right to:

Copy, modify, or create derivative works of the App
Reproduce or redistribute any part of the App's content
Remove any copyright, trademark, or proprietary notices

07 User-Generated Content

You retain ownership of content you upload to GAINUP, including progress photos and nutrition logs. By uploading, you grant us a limited license to store and process that content solely to provide the Service to you.

Your progress photos are private by default and never shared publicly
You are responsible for the accuracy of information you input
You may delete your content at any time by deleting your account

08 Health Disclaimer

Important: GAINUP is a fitness tracking tool, not a medical service. All content is for general informational purposes only.

Always consult a healthcare professional before starting a new exercise or diet program
Stop exercising immediately if you experience pain, dizziness, or discomfort
AI meal analysis provides estimates only — actual values may vary
GAINUP is not responsible for any injury or health issue arising from use of the App
Users with pre-existing conditions should seek medical advice before using the App

09 Limitation of Liability

To the fullest extent permitted by law, GAINUP shall not be liable for any indirect, incidental, or consequential damages, including:

Loss of data or unauthorized account access
Physical injury or health issues from use of the App
Service interruptions or unavailability
Errors or inaccuracies in AI-generated content

Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10 Termination

You may delete your account at any time through the App settings. All personal data is permanently removed within 30 days.

We may suspend or terminate your account immediately, without notice, if you:

Violate these Terms of Service
Engage in fraudulent or abusive behavior
Attempt to compromise the security of the Service

Subscription fees are non-refundable upon termination for violations of these Terms.

11 Governing Law

These Terms shall be governed by applicable laws. Disputes shall first be resolved through good-faith negotiation. If that fails, disputes shall be submitted to binding arbitration.

If any provision of these Terms is found invalid or unenforceable, the remaining provisions continue in full effect.

12 Changes to Terms

We may update these Terms from time to time. When we make significant changes, we will:

Update the "Last updated" date at the top of this page
Notify you through the App with at least 7 days' notice for material changes
Request renewed consent where required by law

Continued use of GAINUP after updated Terms are effective constitutes acceptance.
